    PUBLIC SERVICE.

    AN ACT TO MAKE FURTHER AND BETTER PROVISION FOR THE ESTABLISHMENT, EMOLUMENTS AND CONDITIONS OF SERVICE OF MEMBERS OF THE PUBLIC SERVICE OF THE COLONY.

  62. This Act may be cited as The Public Service Short title.

    Act.

  63. In Parts I to IX inclusive of this Act, unless the context otherwise requires'appointed day' means the date upon which Parts I to IX of this Act shall come into operation;

    'appropriate Commission' means, in relation to any member of the Judicial Department to which section 99 of the Constitution applies, the Judicial Service Commission and, in relation to any other public officer, the Public Service Commission;

    'contract officer' means a person employed in the public service of the Colony for a fixed period of time whether or not such employment is renewable on the expiration of such fixed period of time;

    'contract service' means service in the public service of the Colony by a contract officer;

    'Judicial Service Commission' means the Commission established by section 98 of the Constitution;

    'pensionable' means employed in a pensionable office;

    'pensionable office' means any office which is pensionable under the provisions of any Act Interpretation of Parts I to IX

    7 of 1960.

    Establishment, salary and allowances of posts in Schedule A.

    Pensionable status of posts in Schedule A.

    relating to the pension of persons employed in the public service of the Colony;

    'public officer' means a person who is employed in the public service of the Colony;

    'Public Service Commission' means the Commission established by section 95 of the Constitution;

    'repealed Act' means The Public Service Act 1960.

    PART I.

    ESTABLISHMENT, EMOLUMENTS AND PENSIONABLE STATUS.

  64. -(1) Notwithstanding the provisions of any other Act, the establishment of posts in the public service of the Colony specified in the second column of Schedule A to this Act shall be permanently fixed at the numbers specified in the first column of such Schedule in respect 'of such posts.

    (2) Every public officer holding a post specified in the second column of Schedule A to this Act shall be entitled to receive and shall be paid the annual salary specified in respect of such post or an annual salary at the rate in the scale specified in respect of such post in the third column of such Schedule and in audition thereto shall be entitled to receive and shall be paid a non-pensionable allowance calculated on such salary at the rate per centum per annum specified in the fourth column of such Schedule.

  65. -(1) Every post specified in the second column of Schedule A to this Act, other than the posts of Governor and Aide-ae-Camp, shall be a pensionable office.

    (2) Notwithstanding the provisions of any other Act, but subject to subsection (1) of this section, the whole period of continuous service in the public service of the Colony of every public officer employed in a post specified in Schedule A to this Act, excluding contract service, leave without salary and service whilst under the age of twenty years, whether the whole or any of such service was pensionable or otherwise, shall be deemed to be pensionable service.

  66. -(1) Notwithstanding the provisions of any other Act, the establishment of posts in the public service of the Colony specified in the second columns of Schedules B, C, D, E and F to this Act shall be Establishment, salaries and allowances of posts in Schedules B to F inclusive.

    (2) Every public officer holding a post specified in the second columns of Schedules B, C, D, E and F to this Act shall be entitled to receive and shall be paid an annual salary at a rate in a scale specified in respect of such post in the third column of the Schedule in which his post is specified and in addition thereto shall be entitled to receive and shall be paid a non-pensionable allowance calculated on such salary at the rate per centum per,annum specified in the fourth column of such Schedule:

    Provided that a public officer holding any post specified in the second column of Schedule E to this Act may be paid a salary according to his grade as specified in either of the scales (a) or (b) in the third column of that Schedule and -a non-pensionable allowance calculated on that salary.

  67. -(1) Every post specified in the second columns of Schedules B, C, D and E of this Act shall be a pensionable office.

    (2) Notwithstanding the provisions of any other Act, the whole period of continuous service in the public service of the Colony of every public officer employed in a post specified in Schedules B, C, D and E to this Act, excluding contract service, leave without salary and service whilst under the age of twenty years, whether the whole or any of such service was pensionable or otherwise, shall be deemed to be pensionable service.

  68. The salaries and allowances of officers holding posts specified in the second columns of Schedules A, B, C, D, E and F to this Act shall be paid out of the Treasury by warrant of the Minister for Finance in the usual manner.

  69. Notwithstanding the provisions of!any other Act, the posts in the public service of the Colony which are specified in the first columns of Schedules G, H, I, J, K, L, M and N to this Act shall not be fixed by number.
