Practice and procedure - Appeals — Extension of time

Judgment of the Court:

On 13th February 1979, the appellant was convicted of the following offences:

  • (1) Importing a quantity of Indian hemp contrary to sections 15(5) and 25(2)(a) of the Dangerous Drugs Act.

  • (2) Possession of a quantity of Indian hemp contrary to sections 25(5) and 25(2)(a) of the Dangerous Drugs Act.

He was sentenced to three years imprisonment on each count the sentences to run concurrently with one another. On 3rd January 1980 he gave notice of application for extension of time within which to appeal, that is to say he seeks an extension of nearly one year.

We have carefully considered what he has urged to explain this inordinate delay. We have also studied the record of the proceedings in the court below.

The appellant has really given no adequate reasons for this court to extend time for appealing. If we were to grant this application, we might as well resign ourselves to grant every application of this nature. The rules are there to be obeyed; and we feel that on principle this application must be refused. Application refused.
