On 8 October 2021 I dismissed the Originating Summons in this action and invited submissions on the issue of costs within 21 days.

It is my decision that notwithstanding my finding that neither of the parties before me had standing to direct and manage the Company, there is no basis to depart from the basic rule that costs follow the event. The Plaintiffs have brought the Defendants to court and have not succeeded against them. The Defendants shall therefore be entitled to their reasonable costs to be taxed if not agreed.
