MCCrApp & CAIS 102 of 2013

Commissioner of Police

Appellant appeared Pro Se

Mr Ambrose Armbrister, with Mr Charles Newbold, counsel for respondent

Criminal practice and procedure - Appeal — Extension of time— Sentence — Mitigating factors — Aggravating factors — Sentence affirmed.

Allen, P.

The court accedes to the application for extension of time.

Having heard the submissions, and despite the mitigating factors of the appellant's guilty plea and his good character, the aggravating factors of the amount and nature of the drugs possessed and the fact that the drugs were being imported into The Bahamas from Panama by the appellant using a commercial flight, outweigh the mitigating factors.

In the premises, we find that the sentence of 4 years is appropriate. We therefore dismiss the appeal and affirm the sentence imposed.
