The appellant should have received the benefit of the time he spent on remand, that is, two years between the period 28th January, 2011, to 31st January, 2013. The magistrate's record does not reflect that this was done, hence, this court allows the appellant's appeal. Taking into account the time spent on remand, the appellant is to be released forthwith, that is to say, today.
