210 Medical Practitioners

CHAPTER 210.

MEDICAL PRACTITIONERS.

AN ACT FOR THE PRACTIONERS.

REGISTRATION OF MEDICAL [29th May 1906.] 1. This Act may be cited as The Medical Practitioners Act.

  1. In this Act, unless the context otherwise requires'Minister' means the Minister charged with the responsibility for the administration of this Act.

  2. It shall be unlawful for any person to practise medicine or surgery within the Colony unless such person is registered under this Act.

  3. -(1) A person shall be deemed to practise medicine within the meaning of this Act, who for pecuniary or other valuable consideration treats, heals, cures or relieves or attempts or holds himself out as being able to treat, heal, cure or relieve persons suffering from pain, injury, deformity or disease, whether of mind or body, by the administration of drugs or any other substance whatever possessing, or alleged by the person administering or applying it to possess, whether inherently or as administered or applied by such person, any curative efficacy.

    (2) A person shall be deemed to practise surgery within the meaning of this Act, who for pecuniary or other valuable consideration attempts to perform or holds himself out as being able to perform surgical operations, or to treat fractures, dislocations or bodily derangements or disorders by means of instruments, appliances or medicines, or by any form of manual application.

  4. -(1) It shall be lawful for the Governor to direct the registration under this Act of any of the following classes of persons, who may apply to the Minister for such registration(a) any person registered in the 'Medical Register' under the authority of the Acts of the Imperial Parliament known as the Medical Acts;

    (b) any person who holds a medical surgical degree or diploma of any university institution in the Commonwealth authorised law to grant medical or surgical degrees diplomas;

    or or by or Registration of practitioners.

    Governor may refuse applications and remove names.

    Applications from Out Islands to be made through the commissioner.

    Certificates of registration to be issued.

    (c) any person who holds a medical or surgical degree or diploma of any university or institution in any foreign country, which is authorised by the law of such country, to grant medical or surgical degrees or diplomas and which the Governor may determine to recognise for the purposes of this Act;

    (d) any person who, though not being a person possessing any of the above qualific'ations, is possessed of skill in medicine or surgery:

    Provided that it is shown to the satisfaction of the Governor that it is desirable in the interest of any district of the Colony that such person should be authorised to practise medicine or surgery in such district.

    (2) All persons belonging to classes (a), (b) and (c) shall be registered as qualified practitioners, and all persons belonging to class (d) shall be registered as unqualified practitioners.

    (3) The Governor 'may refuse an application for registration, and may at any time remove from the register the name of any person registered.

    (4) Applications for registration by persons residing in any Out Island district of the Colony shall be made through the commissioner.

  5. --(l) There shall be issued to any person registered as a qualified practitioner under this Act a certificate under the Public Seal and to any person registered as an unqualified practitioner under this Act a certificate under the hand of the Minister.

    (2) Every such certificate, in the case of a person registered as a qualified practitioner shall authorise such person to practise medicine or surgery or both medicine and surgery, in any part of the Colony.

    (3) Every such certificate, in the case of a person registered as an unqualified practitioner, shall authorise such person to practise medicine or surgery or both medicine and surgery in such particular district of the Colony, and subject to such limitations as to the nature and scope of the practice in which such person may engage as may be specified in the certificate.

    (4) Any certificate issued to an unqualified practitioner may at any time be revoked, amended or altered by the Governor.

    (5) Any person registered as an unqualified practitioner who shall practise medicine or surgery in any manner contrary to any of the provisions of the certificate issued to such person under this section shall be liable, on summary conviction, to a penalty of twenty pounds.

  6. -(1) There shall be published annually in the Gazette a list of the persons registered under this Act as unqualified practitioners.

    (2) The list shall state the district of the Colony in which such persons are authorised to practise, and shall indicate the limitations and conditions imposed upon the practice of such persons.

    (3) Printed copies of the said list shall be supplied by the Minister to the Stipendiary and Circuit Magistrates and justices of the peace of the Out Islands, and it shall be the duty of such magistrates and justices to keep the said printed copies publicly exhibited in some conspicuous place 'at their respective offices or residences.

  7. Any person who shall fraudulently procure or attempt to procure himself or any other person to be registered under this Act shall be guilty of an offence against this Act.

    Penalty for fraudulently procuring or attempting to procure registration.

    Penalty for falsely pretending to be or to take or use the name or title of a physician, doctor of medicine, surgeon, professor, etc.

  8. Any person not registered as a qualified practitioner under this Act, who shall wilfully and falsely pretend to be or to take or use the name or title of a physician, doctor of medicine, surgeon, professor or any name, title, addition or description implying, whether in itself or in the circumstances in which it is used, that such person is a medical or surgical practitioner, or that such person is qualified to heal disease or treat mental or bodily disorders or derangements, whether by medicine or surgery or any other means of any kind of description whatsoever, shall be guilty of an offence against this Act:

    Provided that nothing in this section shall preclude any person registered as an unqualified practitioner under this Act from describing or advertising himself as an unqualified medical or surgical practitioner; or shall preclude any medical or surgical practitioner qualified for registration as a qualified practitioner under this Act, but not desiring to practise medicine or surgery, from using any name or title usually borne by medical or surgical practitioners.

  9. Any person not registered under this Act who shall practise medicine or surgery shall be guilty of an offence against this Act.

  10. Any person guilty of an offence against this Act for which no specific penalty is provided shall be liable on summary conviction(a) in respect of a first offence to a penalty of one hundred pounds;

    (b) in respect of a subsequent offence to a penalty of two hundred pounds, together with imprisonment for six months.

  11. No person shall be prosecuted for an offence against this Act except upon the fiat of the Attorney General.

  12. In any proceedings for an offence against this Act in which it is necessary to prove that any person is not registered under this Act, such person shall be deemed not to be registered until the contrary is shown.

  13. Nothing in this Act shall apply to midwives.

  14. Nothing in this Act shall be deemed to restrict the sale or supply of medicine or drugs in the Out Islands.

  15. Every person registered as a qualified practitioner under this Act shall be entitled to recover in due course of law in respect of his practice any expenses, charges in respect of medicaments or other appliances, or any reasonable fees to which he may be entitled, unless he is a fellow or member of a college of physicians or surgeons, the fellows or members of which are prohibited by byelaw from recovering at law their expenses, charges or fees, in which case such prohibitory byelaw, so long as it is in force, may be pleaded in bar of any legal proceeding instituted by such fellow or member for the recovery of expenses, charges or fees.

    DENTISTS.

    AN ACT FOR THE REGISTRATION OF DENTISTS.

    [1st August 1916.] 1. This Act may be cited as The Dentists Act.

  16. In this Act, unless the context otherwise requires'Minister' means the Minister charged with the responsibility for the administration of this Act.

  17. It shall be unlawful for any person to practise dentistry within the Colony unless such person is registered under this Act.

  18. A person shall be deemed to practise dentistry and to act as an operator in dental surgery, within the meaning of this Act, who, for pecuniary or other valuable consideration, treats or attempts to treat or holds himself out as being able to treat, heal, cure or relieve diseases, lesions or pain of the human teeth or jaws, or performs or attempts to perform any...
