    WATER AND SEWERAGE.

    AN ACT TO PROVIDE FOR THE MAINTENANCE OF THE 7 of 1933.

    37 of 1936.

    EXISTING WATER-SUPPLY SYSTEM AND SEWERAGE G.N.7 (1) of SYSTEM IN THE DISTRICT OF NEW PROVIDENCE AND 1964.

    FOR THE EXTENSION THEREOF FROM TIME TO TIME.

    [25th May 1933.] 1. This Act may be cited as The Water and' Short title.

    Sewerage Act.

  36. In this Act, unless the context otherwise Interpretation.

    requires'district' means and includes any area in the Island of New Providence to which the watersupply system or sewerage system extends, or shall from time to time be extended;

    'house-sewer' includes any sewer conduit, pipe, manhole, flushing-chamber, inspection chamber or other appliance connecting any sanitaryfixture with any street-sewer up to the property line of the premises; or, where the streetsewer is constructed within the premises, up to the street-sewer;

    'Minister' means the Minister charged with the G.N.7 (1) of responsibility for the administration of this 1964.

    Act;

    'new premises' means any premises (as hereinafter defined) erected after the commencement of this Act or any premises which have been taken down to an extent exceeding one-half of their cubical measure and re-erected after the commencement of this Act;

    'owner' includes the owner, lessee or occupier of any premises, and the receiver, attorney, agent, manager, guardian or committee of any such owner, lessee or occupier, or any other person in charge or having the control or possession of any premises in right of the owner, or having possession in his own right or in that of his wife or any other person;

    'person' includes joint tenants and tenants in common;

    'premises' includes any dwelling-house, hotel, shop, office, or other place of business, together with its appurtenances;

    'rules' means rules made under this Act;

    'sanitary-fixture' includes any bath, bidet, drinking fountain, lavatory, sink, laundry-tray, water-closet, urinal, cistern, flushing-tank, floor-drain, trap, vent, piping or other appliance used for the collection and conveyance of sewage or fluid house refuse to the housesewer, or the venting thereof;

    37 of 1936, s. 2. 'service pipe or main' means any pipe line of the water-supply system controlled by the Minister and intended for the distribution of water in the district;

    'sewerage system' includes any public latrine, street-sewer, pumping station, pumping machinery, depositing tank, out-fall pipe, and any other appliance for the conveyance or the disposal of sewage;

    'street' includes any square, court, alley, highway, lane, road, thoroughfare, public passage or place, in the Island of New Providence;

    'street-sewer' includes any sewer, pipe, manhole, gully, flushing tank, ventilating opening or shaft which has been or shall be constructed out of public funds, or is to be maintained out of public funds;

    'water-supply system' includes any reservoir, dam, tank, well, tunnel, conduit, pipe, fountain, sluice, valve, pump or engine, and any building, structure or appliance used or constructed for the supply, storage, conveyance, measurement or regulation of water, which is used or constructed for the supply of water to the district by the Minister.

    Maintenance of 3. The Minister shall maintain the existing waterexisting system, supply system and sewerage system within the district, and future extension, and may from time to time extend the same into, through, across, under or over any street or Crown [CH.207. 2377 WATER AND SEWERAGE.

    2377 land, or (subject to the provisions hereinafter contained) any land whatsoever situate within the district.

  37. The Minister may employ persons for the maintenance and extension of the water-supply system and sewerage system at such salaries or other rates of remuneration as he may from time to time determine.

  38. The Minister may enter into any premises within the district or its vicinity at any reasonable hour and examine the same, and make any survey, or plan thereof, or any excavation which may be necessary for the purpose of determining the most suitable position for connecting any water pipe or house-sewer with the water main or street-sewer, and may lay any water pipe or house-sewer from the water main or street-sewer to the property line of any premises.

  39. For the execution of any work to be undertaken or done, or for the inspection or maintenance thereof, the Minister may(a) open up any street in the district;

    (b) divert traffic from one street to another;

    (c) deposit upon any part of any street any material, implement, or thing...
