CHAPTER 198.

BUILDINGS REGULATIONS.

AN ACT TO REGULATE THE CONSTRUCTION OF BUILDINGS AND TO PROVIDE FOR THE RE-INSTATEMENT OR REMOVAL OF DILAPIDATED BUILDINGS.

[22nd July 1954.] 1. This Act may be cited as The Buildings Regulations Act.

  1. In this Act, unless 'the context otherwise requires' building' includes(a) any part of a building and any addition to any building of whatsoever material and in whatsoever manner constructed, any installation machinery and plant fixed or attached to any building or property;

    (b) any wall, fence or similar structure bounded 'by or fronting on!a public highway;

    (c) any other boundary wall, fence or similar structure, provided nothing in this Act shall be construed as preventing such wall, fence or similar structure from being erected to a height not exceeding eight feet;

    'City of Nassau' means the City of Nassau as defined by The Interpretation Act;

    'Minister' means the Minister charged with the responsibility for the administration of this Act;

    'owner' includes an occupier or an agent of the owner;

    'rules' means any rules made under the authority of section 12 of this Act.

  2. -(1) It shall not be lawful to erect or commence to erect or cause or procure to be erected or commenced any building or to make any material change in any building on the Island of New Providence without 24 of 1954.

    first having obtained the sanction of the Minister as to the materials of and method by which such building is intended to be constructed and as to the drainage system to be installed therein:

    Provided that in any case where the sanction of the Minister has been refused, the person aggrieved shall have the right to appeal to the Supreme Court as hereinafter provided.

    (2) If any building shall be erected or the erection thereof shall be commenced in contravention of this section, every person directing or causing such erection to be done shall be guilty of an offence against this Act and shall be liable on conviction to a penalty of fifty pounds.
